Domains and domain disputes
A domain is now as valuable as the name above your door, and just as attractive to speculators. We prepare secure domain transfers for purchases and sales. If someone holds your domain merely to exploit it, we pursue its recovery through a dispute concerning .sk, .cz or .eu domains, with arguments based on your trade marks and business name.

What we'll do for you
Domain matters turn on a combination of what you have registered, what you actually use and how the holder behaves. We therefore assess your prospects first, then choose a demand letter, negotiations or a dispute.

-
Assessing your position
We assess your identifiers (business name, trade marks and use) against the domain holder's position and explain the prospects and costs of each route.
-
Domain transfer
A transfer agreement linking payment to the technical transfer — so neither party is left without both money and domain.
-
Demand letter and negotiations
A legally reasoned demand to the holder and negotiations for a voluntary transfer — a significant proportion of cases are resolved without a dispute.
-
Domain dispute
Handling a domain dispute through the courts or alternative dispute resolution under the relevant registry's rules (.sk, .cz, .eu), depending on which is faster and more effective.
-
Prevention
Audit of your domain portfolio, registration of key variants and arrangements for domains to be held by the company (rather than a former supplier or employee).

Someone holds a domain containing our business name. Can we obtain it?
That depends on your position: a registered trade mark, an identical business name and demonstrable use of the identifier substantially improve your prospects — particularly if the holder does not use the domain or merely offers it for sale. We assess the registry extracts and give you a realistic estimate before you spend money.
How does a dispute over a .sk or .eu domain work?
Alongside court proceedings, several domain extensions offer faster alternative dispute resolution under registry rules — decisions are generally made in writing and faster than in court. The appropriate route depends on the extension and the nature of the case; we recommend the more effective option.
We are buying a domain from a private holder. What should we watch for?
Linking payment to the technical transfer (escrow or stages), the holder's representations concerning third-party rights, and ensuring the transfer includes related accounts and redirects. “I will send the money and they will switch it over” is the most common way to lose both.
Our company's domain is registered to a former supplier. Is that a problem?
A major one — legally, they hold the domain, and recovering it is difficult if a dispute arises or they cease to exist. We resolve this by transferring the holding to the company and adjusting supplier agreements to prevent recurrence. We recommend acting before a conflict arises.
How much do domain services cost?
A transfer with an agreement is a relatively quick matter; a dispute depends on the route and the holder's resistance. We confirm the fee in advance after assessment — and the agreed fee stands.

Common questions on this topic
-
Someone registered a domain using my name or brand. What can I do?
Domain registration alone does not permanently defeat your earlier rights. If the domain infringes your trademark or business name, you can rely on trademark rights or unfair competition protection and seek an end to its use, compensation and potentially transfer of the domain. The approach depends on whether you have a registered mark and how the domain is actually used.

A trademark owner is demanding that we hand over our domain. Must we?
Not automatically. A trademark owner may prohibit the use in the course of trade of an identical sign for identical goods and services, and of a similar sign where there is a likelihood of confusion, but not to the detriment of rights acquired before its application was filed. In alternative dispute resolution for a .sk domain it is also examined whether you have a right or legitimate interest in the domain and whether you acquired and used it in good faith. Do not ignore the demand, but nor should you comply with it before checking your position.

We are buying an e-shop. How do we make sure the domain passes to us as well?
It depends on whether you are buying the company or its business, and on who is actually registered as the holder of the domain. On a purchase of an ownership interest, the domain remains with the company if the company is its holder. On a purchase of the business, the rights covered by the sale pass to the buyer, but the domain registry will record a change of holder only on an application by the existing holder, made through a registrar and with the consent of the new holder. The contract must therefore oblige the seller to take that step, and payment must be tied to it.

Influencer content in brand advertising: what the licence to photos and videos must contain
A brand pays for a post and then finds it may not use the video in paid advertising or on its website. Where the contract is silent, the Copyright Act grants a licence only to the extent needed for the purpose of the collaboration and, unless that purpose implies otherwise, only for Slovakia and for a maximum of one year. This article explains what a contract with a creator must contain so that the content still works after the campaign.
